Altior's Services
Altior helps in the management and pursuit of litigation projects.
How that role is carried out depends on the project.
The following are examples of the services which Altior provides.
Initial assessment
Before a company commits to hiring a full service law firm, Altior can provide it with a preliminary assessment of the merits of the action under consideration.
This gives the company an indication of the strength of its legal position, independent of the advice of the outside lawyers who will be responsible for running the case.
It can assist the company in the selection of the best outside lawyers, in the preparation of a brief for its outside lawyers, and to seek tenders for the project, if the choice of outside lawyer has not already been made.
Development of approaches
It is not always appropriate or necessary to take a Rolls Royce approach to the preparation and execution of a court case.
In many cases, the same result can be achieved more cheaply and efficiently by developing approaches to the litigation which avoid the need for full scale confrontation.
Altior can suggest approaches and strategies to litigation which may limit the scope and cost of the litigation, or hasten its successful resolution.
These approaches may involve the way in which the case is framed or run. They may involve the use of alternative dispute resolution procedures, or the development of a settlement strategy.
In many cases, the suggestion will be to attempt to resolve the problem by negotiation, without recourse to outside lawyers.
Assessment of existing litigation
Where companies have litigation already on foot, management may wish to obtain a second opinion of the prospects of success in the action.
Where the action is likely to succeed, the second opinion may reinforce the commercial justification of proceeding with it. Where the action is not likely to succeed, Altior can suggest ways of reducing or eliminating the company’s exposure to it.
Research
Altior offers the services of Richard Travers to conduct research on legal, factual or strategic issues.
It is often a valuable means of refining an approach to a legal problem to submit the problem to analysis by someone new, who may be able to suggest fresh or different approaches.
His academic writing and his University teaching keep Richard up to date with the latest legal developments.
Submissions, outlines of arguments and proofs of evidence
Altior offers the services of Richard Travers to prepare and write submissions, outlines of arguments and proofs of evidence. This service has proved popular in large cases, because it gives fresh perspectives to those running the case.
Being free of the pressures of running the case, Richard Travers can devote the care and attention that is needed to perfect these vital documents.
Secondment
As in-house lawyers face increasing demands in the commercial and corporate sides of their practices, it is often impossible for them to find time to devote to the management of a large piece of litigation.
In these circumstances, Altior can assist by placing Richard Travers on interim secondment with the client. The secondment may be full-time or part time. It may last the duration of the case, or be limited to part of it – most often, the hearing.
Reporting
It is sometimes difficult for those who are responsible for preparing a case and presenting it in the best possible light in court to monitor how the court is assessing the case.
Altior is able to report to management on the progress of litigation from an independent standpoint. This form of neutral reporting assists in the vital decision to push ahead with litigation, or to seek to settle.
Altior’s aim
Altior’s aim is to provide management with feedback to make informed decisions about the commercial justification of commencing, continuing or settling a court case. The service is intended to keep legal projects under control and within budget, whilst freeing management to concentrate on running their business.
